Sales Agreement

1-Parties

JETBLACK LUXURY TRAVEL AGENCY shall be referred to as ‘jetblackvip.com’ for short.

2-Subject Matter With this agreement, the parties have agreed, within the framework of the following terms and conditions, on the provision of pre- and post-flight transfers from addresses specified by them to airports and vice versa, or one-way or return transfers from locations offered by ‘jetblackvip.com’, as well as daily excursion/tour services, and the fulfilment of these services by jetblackvip.com in exchange for payment. 

3- Service and Payment Information

3.1. The contract price includes VAT.

3.2. The agency may change the vehicle type to another vehicle of the same segment, provided that the consumer is notified in advance. For example, Volkswagen Caravelle instead of Mercedes Vito. If the customer does not accept such a change during the reservation process, they have the right to cancel their reservation and receive a full refund of the fee paid. In this case, the customer is not entitled to compensation.

4-Transfer Type: One Way (Single/Double) 

5-Vehicle Type: The vehicle type selected by the customer (Mini Van - Minibus)

6-Number of Persons: The customer must specify the number of persons. 

7-General Provisions

Passengers are required to wear seat belts in accordance with the Traffic Law.

To avail of the transfer service covered by this contract, the customer must have made a reservation at least 24 (twenty-four) hours prior to the transfer time. During religious and national holidays, New Year's Eve, and other official holidays, the reservation must be made at least 48 (forty-eight) hours prior to the transfer time. Reservations may be cancelled by the customer up to 24 hours prior to the transfer time. In this case, the customer will receive a refund. No refund will be given for reservations cancelled later than this. The route to be followed during the transfer service, from the departure point to the destination, is determined solely by ‘jetblackvip.com’, taking into account traffic, road conditions and other criteria. The customer does not have the authority to change this route. In this context, requests from passengers to stop at a different location along the specified route or to wait for a short time at that location will be accepted. jetblackvip.com is obliged to transport passengers to a specific point between the two specified routes.

Jetblackvip.com does not accept sacks, boxes, parcels, etc. as luggage during the transfer process. Passengers are entitled to a maximum of 15 kg of luggage per person. In the event of loss or damage to luggage for which no declaration of value has been made by the passenger, the customer shall not be entitled to claim the service fee as material or moral compensation. The customer accepts, undertakes and declares that the luggage to be transferred does not contain any flammable, combustible, explosive, narcotic, liquid, odorous, radioactive or any other substance prohibited by Turkish legislation. If the driver detects the presence of items listed in the luggage, the luggage in question will not be accepted into the vehicle. If the removal of the aforementioned items from the luggage exceeds the 15 (fifteen) minute period specified below, no refund will be made in cases where the transfer does not take place for these reasons or where the customer misses their flight due to the time lost. Furthermore, in such cases, the customer cannot claim any compensation or rights from jetblackvip.com under any name. If the presence of the items listed above is detected in the luggage, the situation will be immediately reported by ‘jetblackvip.com’ to the competent authorities. If the presence of the listed items is not detected by the driver and is discovered during the transfer when the vehicle is stopped and searched by law enforcement, ‘jetblackvip.com’ shall be immediately compensated in cash and in full by the customer for any damage or loss incurred as a result. The customer's requests for pet transfer and the type of pet to be transported shall be notified by the customer when purchasing the service online. No animal transfer shall be made without such notification. No animal transfer shall be made without an adult customer accompanying the animal. Animals to be transferred under these conditions may only be transported in their special cage, in the section designated by ‘jetblackvip.com’ personnel within the vehicle, with all responsibility resting with the customer. Under Turkish law, the transfer of animals whose acquisition, possession, or transfer is unlawful is not permitted under any circumstances. For transfers from a specific point to the airport, jetblackvip.com declares and undertakes that the vehicle allocated for the transfer will be at the designated point at the transfer time. A delay of up to 20 (twenty) minutes from the transfer time shall be considered a reasonable delay. In the event of a delay exceeding 20 (twenty) minutes, the customer is not obliged to wait for the vehicle. In this case, the transfer fee will be refunded to the customer. At transfer points such as residential complexes, jetblackvip.com shall not be held responsible if the 15 (fifteen) minute delay period is exceeded due to the site security guards preventing the vehicle from entering the site. If the 15 (fifteen) minute delay is exceeded in this manner and the customer does not wait for the vehicle, no refund will be made. The customer must be present at the designated point at the transfer time with their luggage. If the customer is not present at the transfer point at the transfer time, the vehicle assigned by jetblackvip.com is obliged to wait for the customer for 15 (fifteen) minutes. If the customer does not arrive at the designated point with their luggage after 15 (fifteen) minutes, the vehicle is not obliged to wait any longer.

At the transfer point, jetblackvip.com staff are not required to leave the vehicle to carry luggage or pet carriers, or to accompany the passenger being transferred to the vehicle. Children under the age of twelve will not be transferred without an accompanying adult. The return transfer of the accompanying person to the point of pick-up is subject to the purchase of the return service on the website. If wheelchair transfer is also requested with the customer to be transferred, this will be indicated by the customer when purchasing the service online.

If the customer indicates this when purchasing the service online, one baby seat will be placed in the assigned vehicle by ‘jetblackvip.com’ for 200 TL or 5 €.

8-Force Majeure

Events arising from any type and nature of force majeure beyond the control of the Parties, natural disasters, adverse weather conditions, social events, public disturbances, adverse developments in working life, any legal or illegal actions by workers or employers, strikes, lockouts, union actions and work slowdowns, war, armed conflict, revolution, declaration of martial law or a state of emergency, inter-group conflicts and uprisings, resulting in their inability to fulfil their obligations under this agreement; this agreement shall be suspended until the end of the aforementioned situations/adverse effects. The contract shall come back into force upon the cessation of the aforementioned circumstances/adverse effects. The inability of the parties to fulfil their obligations as a result of force majeure shall not entitle the other party to termination or compensation.

9-Cancellation Conditions and Other Provisions No cancellation, change or refund can be made for any reason for promotional products purchased by the passenger. Requests for cancellation and refunds for reservations with expired dates and times made to the bank or jetblackvip.com shall be invalid.

10-Jurisdiction In the event of any dispute arising from the implementation of this contract, Turkish laws shall apply, and the Antalya Courts and Enforcement Offices shall have jurisdiction.

11-Validity Passengers who are not signatories to the contract but who receive the service covered by the contract shall be deemed to have accepted the terms of this contract by having third parties authorised by them to register on their behalf read this contract and make an online reservation. In the event of any disputes arising from this agreement, the provisions of the Road Transport Act No. 4925 and other relevant Turkish legislation shall apply. The courts and enforcement offices of Antalya shall have jurisdiction. I have read, understood, and accepted this entire agreement drawn up in our name, the date and time of departure, the Road Transport Law No. 4925, and the information on the website, and I have received a copy.

Every user who makes a reservation via www.jetblackvip.com" shall be deemed to have read and accepted this agreement.
